The by-election to fill up the vacant post of Cuttack Municipal Corporation (CMC) mayor will be held today as per the schedule fixed by the State Election Commission.
The filing of nomination for the election will be held between 10 am to 11 am, whereas, the verification of nomination papers will be done between 12 noon to 1 pm.
Candidates can withdraw their nomination between 1 pm to 1:30 pm. The voting will start at 1:30 pm. If more than one candidate files the nomination for the post, the voting will continue till 3 pm.
Yesterday, The Orissa High Court gave a green signal for poll by rejecting the petition of Kanakalata Naik, an aspirant from Ward no 21, challenging the polls.
Naik had challenged the decision of the State Election Commission, which had fixed the polls for the mayor’s post on January 22 without waiting for the bypoll in ward 21, which had fallen vacant on December 29 after the resignation of former mayor Anita Behera over ration card row.
Bench of Justice B K Nayak of the High Court however, did not find any infraction of law in SEC notification saying: “There is no mandate of law that such by-election to fill up the vacancy in the office of corporator must be filled up before election to the office of the mayor is held.”
